Data protection is a core element of the Hong Kong economy. The Personal Data Protection Ordinance (PDPO) sets out the rights of data subjects, specific obligations to data users and regulates the collection, processing, holding and use of personal data through six data protection principles.
The PDPO provides that personal data may be transferred abroad only for the purposes that were notified to the data subject on or before the original collection of their personal data, or for the purpose(s) agreed between the data user and the data subject. It is therefore necessary, in order to ensure that the transfer of personal data abroad complies with the provisions of the PDPO and that the data importer can rely on the standard contractual clauses as having been incorporated into the contract, for the data exporter to carry out a transfer impact assessment.
Although a transfer impact assessment is not mandatory under Hong Kong law, there is a growing number of circumstances in which a Hong Kong business will need to undertake such an assessment by reason of the application of laws of other jurisdictions. This is most commonly the case where a Hong Kong business will be a data importer of personal data of EEA persons from a data exporter in the EEA.
